Nevada overtime

Nevada Overtime & Daily Overtime Calculator

Nevada's daily overtime rule is wage-threshold-driven. Workers earning less than $18.00/hr owe time-and-a-half after 8 hours in a day or 40 hours in a week. Workers at or above $18.00/hr owe overtime only after 40 hours in a workweek. A 4×10 schedule agreement exempts workers from daily overtime.

How Nevada overtime works

Nevada's overtime law is in NRS 608.018. The key differentiator from other states is the wage threshold: your hourly rate determines which overtime rules apply to you.

If you earn less than $18.00/hr

You are owed 1.5× your regular rate for:

The same hours cannot be double-counted — if you work 10 hours on Monday (2 hours of daily OT), those 10 hours count toward your weekly total but the 2 overtime hours do not generate additional weekly overtime on top of the daily premium.

If you earn $18.00/hr or more

You are owed 1.5× your regular rate only for hours over 40 in a workweek. The 8-hour daily threshold does not apply.

The 4×10 schedule exemption

Under NRS 608.018, employees who have agreed in writing to work four 10-hour days per week are exempt from the daily overtime requirement. Weekly overtime (after 40 hours) still applies. The agreement must be voluntary — an employer cannot unilaterally assign a 4×10 schedule to avoid paying daily overtime.

Common questions

Does Nevada have double-time (2×) overtime?

No. Nevada's overtime multiplier is time-and-a-half (1.5×) only. There is no state double-time provision comparable to California's 12-hour or seventh-day rules.

Is Nevada overtime calculated daily, weekly, or both?

For workers earning under $18.00/hr, both — daily (after 8 hours) and weekly (after 40 hours), without double-counting the same hours. For workers at $18.00/hr or more, only weekly.

What agency enforces overtime in Nevada?

The Nevada Office of the Labor Commissioner (labor.nv.gov) enforces state wage and overtime laws. Covered employers also owe FLSA obligations enforced by the U.S. Department of Labor Wage and Hour Division.
