Discharge (involuntary termination)
NRS 608.020requires that an employer who discharges an employee — including layoffs and terminations for cause — pay all wages due immediately at the time of discharge.
Resignation or voluntary quit
NRS 608.030gives the employer until the next regular payday or 7 days after the last day of work, whichever comes first.
Continuation wages for late payment
Under NRS 608.040, if an employer willfully fails to pay final wages on time, the employee may be entitled to continuation wages at the same daily rate for up to 30 days until paid. Consult the Nevada Labor Commissioner or legal counsel for specific enforcement guidance.
What must be included
All wages earned, including accrued vacation if the employer's policy treats it as earned wages, must be paid. Check your employer's written vacation/PTO policy and any CBA that may apply.
